ferm LIVING Australia Pty Limited (ABN 26 051 606122), its directors, officers, employees, agents, contractors, successors and assigns are referred to as "ferm LIVING Australia" in these Terms and Conditions.
Privacy Policy
Personal details are collected for the transaction process and for confirmation of credit card details. This information will not be sold or released to third parties unless such disclosure is required by law or to outsource to companies who are required to hold such information. This includes but is not limited to hosting servers. We may use your information from time to time to notify you about special offers, new products and events. If you do not wish to receive such information please contact us at info@fermliving.com.au Please inform us immediately if you believe there has been a breach of your privacy.
Security Policy
The payment page is an SSL secured NAB (National Australia Bank) page hosted on NAB servers. When filling out your payment details, confirm by finding the LOCKED padlock at the bottom or top right of the browser window (depending on the browser being used). We do not keep your credit card details.
Purchase Order
You can place an order on this web site by clicking the "Add to Shopping Cart" links and by clicking the "View Cart/Checkout" and "Continue to Payment Page" links. If you have entered an email address you will receive an email confirmation of your order. Alternatively, we will post an order confirmation to you. Your order may be unsuccessful due to unavailability of stock or your payment details being incorrect or not authorised.
If your item is marked out of stock, please contact us at orders@fermliving.com.au and we will give you an estimate of the delivery date.
Our shopping cart accepts VISA, Mastercard, AmEx, Mastercard. If you would prefer to pay by direct deposit, please contact us by email at info@fermliving.com.au or phone us on 0425 327 107 or (02) 9817 0457. We do not accept personal cheques.
Delivery
We charge a postage and handling charge depending upon the size and weight of the order. These are detailed in the FAQ section. We deliver Australia wide by Express Parcel Post unless you request otherwise. If you would prefer a courier or if you are ordering a large number of goods, please contact us at info@fermliving.com.au for alternative delivery charges.
Please make sure that your address details are correct as we may have to charge a redelivery fee if your delivery address details are incorrect.
Returns and Faulty Goods
We will refund within 14 days of delivery date, less delivery charges, provided the product is in its original condition and returned in undamaged packaging. Please email us at info@fermliving.com.au before returning the product to us so that we can give you a return code. It is your responsibility to pay the costs of return Express Parcel Post and to insure the goods. We are not responsible for lost packages.
If your goods arrive damaged or are otherwise faulty, please contact us within 7 days of receipt of the goods at orders@fermliving.com.au Please keep the goods and all packaging. We will arrange for the return of the damaged goods and for replacements to be sent to you.
Restrictions on Use
You must not use the content of this site for any illegal purpose or in any manner inconsistent with these Terms and Conditions. You cannot, without the prior written consent of ferm LIVING Australia, copy, reproduce, recompile, decompile, disassemble, reverse engineer, frame, distribute, publish, display, perform, modify upload to, create derivative works from, transmit or in any way exploit this site, except as permitted by the Terms and Conditions or by law. You must not interfere or disrupt networks connected to this web site.
Intellectual Property Rights
This site includes copyright, trademarks, designs, images and text that is protected by law. Except as expressly authorised by ferm LIVING Australia or by ferm LIVING ApS, use or misuse of this intellectual property is not permitted.
Liability
Any liability arising out of the provision of goods or services to you (other than conditions or warranties implied by law and to the maximum extent permitted by law) will, at the election of ferm LIVING Australia, be limited to the replacement of the goods or the supply of the services.

ferm LIVING Australia does not warrant that this web site is compatible with your equipment or that it is free of errors or viruses or worms and ferm LIVING Australia is not liable for any damage you may suffer as a result of such destructive features. ferm LIVING Australia is not liable for any damages arising out of your use or misuse of this site. Information on this site may contain technical or typographical errors. ferm LIVING Australia reserves the right to correct and change the information on this site at any time.
Governing Law
These terms and conditions are to be construed in accordance with the laws of New South Wales.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the other provisions will remain in force.
